1. Acceptance of these terms

Vydstudio ("we," "us") operates the AI video studio at vydstudio.ai. By creating an account or using the service, you agree to these Terms of Service. If you don't agree, please don't use the service.

2. What Vydstudio does

Vydstudio is an AI video studio. You describe what you want and we generate short- and long-form videos using third-party AI models, then optionally help you publish them to platforms you connect, such as YouTube, TikTok, Instagram and Facebook. The service is provided "as is" and we may modify, suspend or discontinue features over time.

3. Your account

You're responsible for keeping your login credentials safe and for everything that happens under your account. One human per account; you can't share an account between people. You must be old enough to form a binding contract in your country to use Vydstudio.

4. Subscriptions, credits and billing

Plans renew monthly or yearly until you cancel. Credits reset on your billing date and don't roll over. Billing is handled by our payment processor. We can revise pricing with at least 30 days' notice; price changes never affect your current billing period.

5. Acceptable use

Don't use Vydstudio to generate content that infringes third-party rights, depicts non-consensual sexual content, sexualises minors, promotes violence or hatred, or violates the policies of the underlying model providers (Google, Kling AI, ByteDance, Happy-Horse and HeyGen). Don't use the service to break the law or to violate the terms of any platform you connect. Violations can result in account suspension and forfeiture of unused credits.

6. Connected platforms and the YouTube API Services

When you connect a third-party account (for example YouTube, TikTok, Instagram or Facebook), you authorise Vydstudio to act on your behalf to read basic account details and to publish the videos you create. You remain responsible for complying with each platform's own rules.

Vydstudio uses the YouTube API Services to let you connect your YouTube channel and upload and manage videos you generate. By using these features, you agree to be bound by the YouTube Terms of Service. Our use of YouTube data is described in our Privacy Policy, which also explains how to revoke our access and delete the YouTube data we store. You can revoke Vydstudio's access at any time from your Google security settings or by disconnecting the channel in Vydstudio.

7. Ownership of generated content

You own the videos you generate, subject to the underlying model providers' output licences. You can use them commercially, re-edit them, and post them anywhere. We never claim rights over your output.

8. Refunds

Subscriptions are non-refundable, but if you hit a generation failure that wasn't your fault we'll re-credit the affected segments automatically. This is in addition to any rights you have under applicable consumer law (see section 9).

9. Disclaimers and limitation of liability

The service is provided "as is" without warranties of any kind. To the extent permitted by law, our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that you have under the Australian Consumer Law or other law that cannot lawfully be excluded. Where our liability for a failure to comply with a non-excludable guarantee can be limited, it is limited (at our option) to re-supplying the service or paying the cost of re-supply.

10. Termination

You can stop using Vydstudio and delete your account at any time. We may suspend or terminate your account if you breach these terms. On termination, your right to use the service ends, though sections that by their nature should survive (such as ownership, disclaimers and limitation of liability) continue to apply.

11. Changes to these terms

We may update these terms from time to time. If we make material changes we'll update the date above and, where appropriate, notify you. Continuing to use the service after a change means you accept the updated terms.

12. Governing law

These terms are governed by the laws of the State of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that State.

13. Privacy

Your use of Vydstudio is also governed by our Privacy Policy, which explains what we collect and how we handle it, including data accessed through the YouTube API Services.
